Chapter 1 General Provisions
(Purpose)

Article 1 This Act aims to ensure the protection of persons who have suffered or are likely to suffer damage from a disaster and the maintenance of social order by the national government, in cooperation with local public entities, the Japanese Red Cross Society, other organizations, and the public, through the provision of necessary emergency rescue measures in the event of a disaster or the likelihood of a disaster occurring.

Article 2 Rescue under this Act (hereinafter referred to as “rescue”) shall, except as otherwise provided in this Act, be conducted by the governor of a prefecture in cities (including special wards; the same shall apply hereinafter) where a disaster of the degree specified by Cabinet Order has occurred (hereinafter referred to as “disaster-affected municipalities” in paragraph 3 and Article 11) where a disaster of the extent specified by Cabinet Order has occurred. 2. In cases where there is a risk of a disaster occurring, if a specific disaster countermeasure headquarters as prescribed in Article 23-3, Paragraph 1 of the Disaster Countermeasures Basic Act (Act No. 223 of 1961),
an emergency disaster countermeasure headquarters as prescribed in Article 24, Paragraph 1 of the same Act, or an urgent disaster countermeasure headquarters as prescribed in Article 28-2, Paragraph 1 of the same Act is established, and the jurisdiction area of the headquarters is announced in accordance with the provisions of Article 23-3, Paragraph 2 (including cases where the provisions of Article 24, Paragraph 2 or Article 28-2, Paragraph 2 of the same Act are applied by analogy; the same applies hereinafter in this paragraph), the governor of the prefecture may also provide rescue services to persons within the jurisdiction of the headquarters (referred to as “municipalities within the jurisdiction of the headquarters” in the following paragraph and Article 11) who are at risk of suffering damage from the disaster and currently require rescue services. However, this does not apply in cases where the provisions of the preceding paragraph are applied or where the abolition of the headquarters has been announced pursuant to the provisions of Article 23-3, Paragraph 2 of the same Act.

3. When providing rescue services pursuant to the provisions of the preceding two paragraphs, the prefectural governor must publicly announce the fact and the area of the municipality where the disaster occurred or the municipality within the jurisdiction of the headquarters. The same applies when the rescue services are terminated.
